Agreement to Terms.
These Terms of Service ("Terms") form a legal agreement between you and Valenzuela Fence LLC ("Valenzuela Fence," "we," "us," or "our"), a Colorado limited liability company.
By visiting our website, requesting a quote, communicating with us, or hiring us to perform work, you agree to these Terms. If you don't agree, please don't use our website or services.
These Terms apply alongside our Privacy Policy, which explains how we handle your information.

Our Services.
Valenzuela Fence provides residential and commercial fencing services across the Denver, Colorado metropolitan area, including:
- Custom Western Red Cedar fence design and installation
- Chain link, ornamental iron, and specialty fencing
- Fence repair and replacement
- Deck restoration, power washing, and staining
- Related outdoor carpentry and finishing services
We serve homeowners, HOAs, and commercial property managers across the Denver metro and Front Range. Service availability outside our standard service area is at our discretion.

Quotes & Estimates.
We provide free, no-obligation quotes for fence and deck projects. Quotes are typically delivered within 24–72 hours of an on-site assessment.
What a quote covers
Our written quotes describe materials, scope of work, estimated timeline, and total price. Unless explicitly noted, quotes assume:
- Standard ground conditions (no rock, buried utilities issues, or excessive slope)
- Clear access to the work area
- No HOA or permit complications beyond normal review
- Material prices current as of the quote date
Quote validity
Quotes are generally valid for 30 days from issuance unless otherwise stated. After 30 days, prices may require revision due to material cost changes, schedule availability, or other factors.
Change orders
If you request changes after work begins, or if conditions discovered on-site require additional work (rock encountered during digging, rotted material concealed behind existing structures, etc.), we'll provide a written change order describing the additional cost before proceeding.

Service Contracts.
For projects exceeding informal repair work, we provide a written service agreement covering:
- Detailed scope of work and materials
- Total price and payment schedule
- Estimated start and completion dates
- Warranty terms
- Cancellation policy
Deposits & payment
Most projects require a deposit at the time of signing, with the balance due upon completion. For larger projects, we may use a progress payment schedule. Specific terms will be detailed in your service agreement.
Cancellation
Under Colorado law, you generally have three (3) business days to cancel a home improvement contract signed in your home without penalty. Cancellation must be in writing. After this period, cancellation may result in forfeiture of deposit or charges for materials already ordered or work already begun.
Project delays
We do our best to start and complete projects on schedule. However, delays may occur due to weather, material availability, permit delays, or unforeseen site conditions. We'll keep you informed if your project timeline shifts.

Online Payments & Billing.
For your convenience, we accept online payments for deposits, progress payments, and final invoices in addition to traditional methods (check, Zelle, in-person card).
Accepted payment methods
- Credit and debit cards: Visa, Mastercard, American Express, Discover (processed via Stripe)
- ACH bank transfers: direct from your bank account (processed via Stripe; lower processing fees may result in a small discount on the invoice)
- Zelle: bank-to-bank transfer at no cost
- Check: made payable to "Valenzuela Fence LLC"
- In-person card: chip, swipe, or contactless via Square at your home or our office
Payment authorization
By submitting payment through any of these methods, you authorize Valenzuela Fence LLC to charge the agreed-upon amount. For card payments, you represent that:
- You are the authorized cardholder or have permission to use the card
- The information you provide is accurate and current
- Sufficient funds or available credit exist to cover the transaction
Processing fees & surcharges
We do not add surcharges for credit card payments. Card processing fees are absorbed as a cost of doing business. ACH and Zelle payments may receive a small discount on certain invoices when offered — this will be clearly noted on your quote or invoice.
Failed payments
If a payment fails (declined card, insufficient funds, returned check), we'll contact you to arrange an alternate payment method. Returned checks are subject to a $35 NSF fee as permitted by Colorado law. Project work may be paused until payment is resolved.
Refund policy
Refunds are governed by your signed service agreement and the Colorado 3-day cancellation right described in Section 4. Generally:
- Within 3 business days of contract signing: full refund of any deposit (Colorado in-home contract law)
- After 3 days, before materials ordered: deposit refundable minus a reasonable administrative fee for time spent on quoting, design, and scheduling
- After materials ordered: deposit applied to material costs; any remainder may be refunded if materials are returnable
- After work has begun: refunds calculated based on work completed, materials used, and labor invested; no refunds for completed work that meets agreed specifications
Refunds are returned via the original payment method when possible (typically within 5–10 business days for cards, 1–3 business days for ACH/Zelle).
Chargebacks
If you have a billing dispute, please contact us first at info@valenzuelafence.com or (720) 790-3088. We work hard to resolve issues directly. Filing a chargeback before contacting us may result in collection costs being added to your account, and we reserve the right to dispute fraudulent or unjustified chargebacks with the card issuer.
Late payments
Final invoices are due upon project completion unless otherwise stated in your service agreement. Invoices unpaid after 30 days may incur a late fee of 1.5% per month (18% APR) on the outstanding balance, the maximum permitted under Colorado law. Persistent non-payment may result in a mechanic's lien being filed against the property as permitted by Colorado statute.
Tax
Sales tax, where applicable, is calculated and collected based on the project location. Most fence and deck installation labor in Colorado is taxable. Materials are taxed at the rate applicable to your project's address. Tax amounts are itemized separately on your invoice.
Receipts & invoices
You'll receive an emailed receipt for every payment processed online, and a final paid invoice upon project completion. Keep these for your records — they may be needed for warranty claims, insurance purposes, or tax deductions related to home improvements.

Workmanship Warranty.
We back our installation work with a 5-year workmanship warranty. This warranty covers:
- Defects in our installation craftsmanship
- Posts that fail due to improper setting
- Structural failures attributable to how we built the fence
What's not covered
Our workmanship warranty does not cover:
- Natural wood characteristics (warping, checking, color changes, knots — these are normal for cedar)
- Damage from severe weather, accidents, or vandalism
- Damage from improper maintenance or staining
- Settling or movement caused by ground conditions outside our control (frost heave, soil shifting, irrigation)
- Modifications or repairs done by others after our installation
- Stain, paint, and finish life — these have their own manufacturer warranties
Filing a warranty claim
To file a claim, contact us at info@valenzuelafence.com or (720) 790-3088. Provide photos of the issue, your project address, and your approximate installation date. We'll inspect the issue and repair or replace as appropriate.
This warranty is non-transferable and applies only to the original property owner who hired us. Material warranties (cedar lumber, hardware, stain) are governed by the manufacturers' warranties, which we'll help you reference if needed.

SMS Communications.
If you check the SMS consent box on any of our forms, you agree to receive text messages from Valenzuela Fence at the phone number you provided.
Types of messages
Messages may include appointment confirmations, project updates, quote follow-ups, schedule changes, and occasional promotional offers.
Frequency & charges
Message frequency varies. Standard message and data rates from your wireless carrier apply.

Website Use.
You may use our website for personal, non-commercial purposes — to learn about our services, request quotes, and contact us. You agree not to:
- Use the site for any illegal purpose
- Attempt to access areas of the site not intended for public use
- Scrape, copy, or systematically harvest content from the site
- Submit false information or impersonate others
- Upload malware, viruses, or harmful code
- Interfere with site security or functionality
- Use automated tools (bots, scrapers) without our express permission

Intellectual Property.
All content on our website — including text, photos of our work, logos, design elements, and code — is owned by Valenzuela Fence LLC or used with permission. You may not reproduce, distribute, or create derivative works from our content without written permission.
Project photos
Photos we publish of completed projects are taken on properties where we performed work. We make reasonable efforts to avoid showing identifying details (house numbers, faces, license plates). If you're a customer and prefer that photos of your project not appear publicly, contact us and we'll remove them.

User-Provided Content.
If you submit photos, descriptions, reviews, or other content to us (for example, photos of your property when requesting a quote), you grant us a non-exclusive, royalty-free license to use that content for purposes of providing services to you and, where appropriate, for marketing — though we'll always seek explicit consent before using identifiable customer content in advertising.
You represent that any content you submit is yours to share and doesn't violate anyone else's rights.

Disclaimers.
Our website is provided "as is" and "as available." While we work hard to keep it accurate and functional, we make no warranties that:
- The site will be uninterrupted, secure, or error-free
- Information on the site is complete, current, or accurate at all times
- Pricing examples or general timelines apply to your specific project (only a written quote does)
Any information provided on our website is for general educational purposes. Specific advice for your project requires a consultation.

Limitation of Liability.
To the maximum extent permitted by Colorado law, Valenzuela Fence LLC's total liability to you for any claim related to our website is limited to one hundred dollars ($100).
For claims related to actual fence or deck work performed under a service agreement, our liability is governed by that signed agreement and applicable law, and is generally limited to the amount you paid us for the work in question.
We are not liable for indirect, consequential, special, or punitive damages, including lost profits, loss of use, or property damage beyond the scope of work performed.
Some jurisdictions don't allow certain liability limitations, so portions of this section may not apply to you.

Indemnification.
You agree to indemnify and hold harmless Valenzuela Fence LLC, its owners, employees, and contractors from any claims, damages, or expenses (including reasonable legal fees) arising from:
- Your violation of these Terms
- Your violation of any law or third-party right
- Inaccurate information you provide to us
- Your use of our website or services

Disputes & Governing Law.
These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.

If informal resolution fails
Any dispute arising under these Terms or any service agreement that cannot be resolved informally shall be resolved in the state or federal courts located in Denver County, Colorado. You and Valenzuela Fence agree to submit to the personal jurisdiction of those courts.
Time to file claims
Any claim related to our website or services must be filed within one (1) year of the events giving rise to the claim, or be permanently barred.

Termination.
We may terminate or suspend your access to our website at any time, without notice, for conduct we believe violates these Terms or is harmful to other users, us, or third parties.
Termination of your access to our website does not terminate any signed service agreement, which is governed by its own terms.

Changes to These Terms.
We may update these Terms from time to time. When we do, we'll update the "Last Updated" date at the top of this page. Continued use of our website after changes means you accept the updated Terms.
For material changes that affect your rights, we'll do our best to notify active customers by email before the changes take effect.
